Questo documento ("Informativa") è stato redatto al fine di consentirti di comprendere in che modo i tuoi Dati Personali, come più sotto definiti, saranno trattati da SEI.

In generale, ogni informazione o Dato Personale che fornirai a SEI, nell'ambito della finalità di ricerca e selezione del personale, sarà trattato secondo i principi, internazionalmente riconosciuti, di liceità, correttezza, trasparenza, limitazione delle finalità e della conservazione, minimizzazione dei dati, esattezza, integrità e riservatezza.

• 1. Titolare del trattamento e Responsabile della protezione dei dati

  SEI, come identificato all'inizio dell'Informativa, è il Titolare del trattamento relativamente a tutti i Dati Personali che sono trattati nell'ambito del processo di selezione. • 2. I dati personali oggetto di trattamento

  Ti informiamo che SEI tratterà i tuoi Dati Personali, che potranno essere costituiti da un identificativo come il nome, un numero di identificazione, un identificativo online o a uno o più elementi caratteristici della tua identità fisica, fisiologica, psichica, economica, culturale o sociale idonea a renderti identificato o identificabile ("Dati Personali").
  I Dati Personali trattati da SEI sono:

  • a. Candidature

    Tramite la tua candidatura, compilando un questionario o successivamente durante il colloquio, potresti fornire a SEI i tuoi dettagli professionali/lavorativi (ad es. università frequentata, conoscenza delle lingue straniere, qualifiche professionali, aspettative del candidato e luogo di lavoro desiderato, link ai tuoi profili professionali sui social network, ecc.), la tua immagine nonché la tua cover letter ("Domanda").

    Alla ricezione di una Domanda, SEI potrà valutare, anche se non li avrai indicati nella Domanda, i tuoi profili professionali sui social network (ad es. LinkedIn) o siti professionali a te riferibili, se pubblicamente accessibili, per avere ulteriori informazioni utili a valutare la tua compatibilità con la posizione per cui ti candidi.

    Eventuali dichiarazioni non veritiere rilasciate tramite la Domanda e/o in fase di eventuale proposta di lavoro, potrebbero dal luogo alla revoca della suddetta proposta o, se scoperte nel corso del rapporto di lavoro, alla risoluzione dello stesso.

  • b. Speciali categorie di dati personali

    In alcuni casi la tua Domanda potrebbe contenere dati particolari riferibili a te o a terzi soggetti, come disabilità di genitori, figli o parenti. SEI non intende utilizzare queste informazioni a meno che non siano necessarie o richieste per la posizione a cui sei interessato (es. se la posizione è rivolta a categorie protette). In caso contrario, ti invitiamo a eliminarle prima dell'invio della tua Domanda o a non segnalarle successivamente. Laddove tu le comunichi comunque e non siano pertinenti, ti informiamo che queste non verranno prese in considerazione, in conformità a quanto previsto dal provvedimento dell'Autorità Garante per la protezione dei dati personali n. 146 del 5 giugno 2019. Laddove, invece, la raccolta di dati particolari sia necessaria per istaurare il rapporto, nonché giustificata da scopi determinati e legittimi, il trattamento sarà basato per assolvere gli obblighi ed esercitare i diritti specifici del titolare o dell'interessato in materia di diritto del lavoro e della sicurezza sociale e protezione sociale.

• 3. Finalità del trattamento

  SEI utilizzerà i tuoi Dati Personali per le seguenti finalità:

  • esaminare le Domande dei candidati al fine di un eventuale contatto ("Recruitment");
  • assolvere ad obblighi di legge che impongono a SEI la raccolta e/o l'ulteriore elaborazione di determinati tipi di Dati personali ("Compliance");
  • prevenire o individuare qualsiasi abuso o qualsiasi attività fraudolenta e dunque permettere a SEI di tutelarsi in giudizio ("Abusi/Frodi").

• 4. Base legale e natura obbligatoria o facoltativa del trattamento

  Le basi legali utilizzate da SEI per trattare i tuoi Dati, secondo le finalità indicate nel precedente paragrafo 3, sono le seguenti:

  • Recruitment: il trattamento per questa finalità serve a SEI per poter prendere in considerazione la tua Domanda e, quindi, è necessario per poter avviare il processo di selezione al fine di offrirti, eventualmente, una posizione lavorativa. Non è obbligatorio fornire a SEI i tuoi Dati Personali per questa finalità, ma in caso contrario non sarà possibile prendere in considerazione la tua Domanda.
  • Compliance: il trattamento per questa finalità è necessario per SEI al fine di assolvere eventuali obblighi di legge. Quando fornisci dei Dati Personali a SEI, dovranno essere trattati secondo la normativa applicabile, il che potrebbe comportare la loro conservazione e comunicazione alle Autorità per obblighi contabili, fiscali o di altra natura.
  • Abusi/Frodi: le informazioni raccolte per questa finalità saranno usate esclusivamente per prevenire e/o individuare eventuali attività fraudolente o abusi e dunque permettere a SEI di tutelarsi in giudizio.

• 5. Destinatari dei dati personali

  I tuoi Dati Personali potranno essere condivisi con i soggetti indicati di seguito (i "Destinatari"):
  soggetti che agiscono tipicamente in qualità di Responsabili del trattamento per SEI ossia: i) persone, società o studi professionali che prestano attività di assistenza e consulenza a SEI in materia contabile, amministrativa, legale, tributaria, finanziaria e altre;

  soggetti con i quali sia necessario interagire per funzionalità informatiche (ad esempio gli hosting provider o i fornitori di piattaforme per l'invio di mail);

  soggetti delegati a svolgere attività di manutenzione tecnica (inclusa la manutenzione degli apparati di rete e delle reti di comunicazione elettronica);

  persone autorizzate da SEI al trattamento di Dati Personali necessario a svolgere attività per conto di SEI, che si siano impegnate alla riservatezza o abbiano un adeguato obbligo legale di riservatezza (es. dipendenti di SEI);

  la controllante Samsung Electronics Co., Ltd e Samsung Electronics (UK) Ltd. per fini amministrativi e contabili interni sulla base del legittimo interesse del gruppo imprenditoriale (quali ad es. l'invio del suo CV ai responsabili interni con i quali potrà eventualmente sostenere un colloquio;

  soggetti, enti od autorità a cui sia obbligatorio comunicare i tuoi Dati Personali per finalità di Compliance, Abusi o Frodi, o per ordini delle Autorità;

• 6. Trasferimenti dei dati personali

  Considerata la presenza internazionale di SEI, alcuni dei tuoi Dati Personali sono condivisi con Destinatari che si potrebbero trovare al di fuori dello Spazio Economico Europeo.

  SEI assicura che il trattamento dei tuoi Dati Personali da parte di questi Destinatari avviene nel rispetto della normativa applicabile. Invero, i trasferimenti vengono effettuati tramite adeguate garanzie, quali decisioni di adeguatezza, Standard Contractual Clauses approvate dalla Commissione Europea o altre. • 7. Conservazione dei Dati Personali

  I Dati Personali trattati per la finalità di Recruitment saranno conservati da SEI per il periodo strettamente necessario al perseguimento delle finalità sopraindicate e comunque per un periodo non superiore a 12 (dodici) mesi dal ricevimento del curriculum vitae o dall'ultimo aggiornamento. SEI si riserva la facoltà di contattare i candidati prima dello scadere di tale periodo per richiedere loro di estendere il periodo di conservazione dei loro Dati Personali o per chiedere un aggiornamento della Domanda. In caso di mancata risposta, SEI eliminerà i Dati Personali raccolti.

  I Dati Personali trattati per la finalità di Compliance saranno conservati da SEI per il periodo previsto da specifici obblighi legali o dalla normativa applicabile.

  I Dati Personali trattati al fine di prevenire Abusi/Frodi saranno conservati da SEI per il tempo strettamente necessario alla suddetta finalità e dunque fino al momento in cui SEI sarà tenuta a conservarli per tutelarsi in giudizio e comunicare detti dati alle Autorità competenti.

• 8. Diritti dell'interessato

  Hai il diritto di chiedere a SEI, in qualunque momento:

  • l'accesso ai tuoi Dati Personali, (o una copia di tali Dati Personali), nonché ulteriori informazioni sui trattamenti in corso su di essi;
  • la rettifica o l'aggiornamento dei tuoi Dati Personali trattati da SEI, laddove fossero incompleti o non aggiornati;
  • la cancellazione dei tuoi Dati Personali dai database di SEI;
  • la limitazione del trattamento dei tuoi Dati Personali da parte di SEI;
  • di ottenere in un formato strutturato, di uso comune e leggibile da dispositivo automatico i Dati Personali che ti riguardano;
  • opporti al trattamento dei tuoi Dati Personali da parte di SEI.

Samsung Electronics Italia S.p.A., with registered offices at via Mike Bongiorno 9, 20124 Milano (MI), ("SEI"), is committed to protecting the privacy of those (the "Candidates") who send them their job application (the "Application"). As such, this Privacy Policy has been written in order to allow you to understand SEI's policy regarding your privacy, as well as how your personal information will be handled by SEI.

In general, any information and data which you provide to SEI or which is otherwise gathered by SEI, in the context of the conclusion or execution of the Agreement, will be processed by SEI in a lawful, fair and transparent manner. To this end, and as further described below, SEI takes into consideration internationally recognised principles governing the processing of personal data, such as purpose limitation, storage limitation, data minimisation, data quality and confidentiality

• 1. Data controller

  SEI, as identified at the top of this Privacy Policy, is the data controller regarding all personal data processing carried out in the context of the selection process of the Candidates. • 2. Personal Data processed

  In the context of the Agreement SEI will collect and process information regarding you (as an individual) that may be such as your name, an identification number, an online ID or one or more characteristic elements of your physical, physiological, mental, economic, cultural or social identity, which allows you to be identified either by itself, or together with other information which has been collected ("Personal Data").
  Personal Data which can be processed are as follows:

  • a. Job applications

    Through your Application, filling in a questionnaire or during an interview, you may provide to SEI your professional/employment details (e.g., resume, professional qualifications, Candidate's expectations and wished workplace, availability to start) as well as your image and your cover letter.

    When receiving a job application, SEI may assess your professional social media accounts (e.g. LinkedIn) or professional websites, where publicly available, to gain insight as to your suitability for position applied for.

    Any false declarations given in the Application and/or during the selection and hiring process (proposal) may lead to the withdrawal of the proposal, or to the resolution of work contract when discovered during the employment relationship.

  • b. Special categories of Personal Data

    Within the Application you may have disclosed special categories of Personal Data referred to you or third parties, such as data revealing disabilities of your parents, children or relatives. SEI does not intend to use this information unless it is necessary or required for the position you are interested in (e.g. if the position is for "protected categories"). If this is not the case, please delete it before submitting your application or do not report it afterwards. In the event that you nevertheless communicate the information and if it turns out to be irrelevant, we inform you that it will not be taken into consideration, in accordance with the provision no. 146, 5 June 2019, of the Italian Supervisory Authority. Where, on the other hand, the collection of special data is necessary for the establishment of the relationship, as well as justified by specific and legitimate purposes, the processing will be based on the fulfilment of obligations and the exercise of specific rights of the data controller or the data subject in the field of labour law and social security and protection.

• 3. Purposes of processing

  SEI intends to use your Personal Data for the following purposes:

  • To examine Candidate's Applications and to get in contact with Candidates for a possible interview ("Recruitment");
  • For compliance with laws which impose upon SEI the collection and/or further processing of certain kinds of Personal Data ("Compliance");
  • To prevent and detect any fraudulent activities carried out against SEI ("Misuse/Fraud")

• 4. Grounds for processing and mandatory / discretionary nature of processing

  SEI's legal bases to process your Personal Data, according to the purposes identified in Section 3, are as follows:

  • Recruitment: processing for this purpose is needed in order for SEI to be able to consider offering you a position and, therefore, is necessary to take steps at your request before (potentially) entering into a contract. It is not mandatory for you to give SEI your Personal Data for these purposes; however, if you do not, SEI will not be able to consider your applications.
  • Compliance: processing for this purpose is necessary for SEI to comply with its legal obligations. When you provide any Personal Data to SEI, it must process it in accordance with the laws applicable to it, which may include retaining and reporting your Personal Data to official authorities for compliance with tax, customs or other legal obligations.
  • Misuse/Fraud: Information collected for this purpose is used exclusively to prevent and detect fraudulent activities or misuse (for potentially criminal purposes).

• 5. Recipients of Personal Data

  Your Personal Data may be shared with the following list of persons / entities ("Recipients"):

  • Persons, companies or professional firms providing SEI with advice and consultancy regarding accounting, administrative, legal, tax, financial and debt collection matters and which act typically as data processors on behalf of SEI;
  • Entities engaged for IT activities (e.g., hosting providers or e-mail platform providers);
  • Persons authorised to perform technical maintenance (including maintenance of network equipment and electronic communications networks);
  • Persons authorised by SEI to process Personal Data needed to carry out activities for SEI, who have undertaken an obligation of confidentiality or are subject to an appropriate legal obligation of confidentiality (e.g., employees of SEI);
  • Samsung Electronics Co., Ltd and Samsung Electronics (UK) Ltd. for internal administrative purposes, including the processing of clients' or employees' Personal Data; and
  • Public entities, bodies or authorities to whom your Personal Data may be disclosed, in accordance with the applicable law or binding orders of those entities, bodies or authorities;

• 6. Transfers of Personal Data

  Some of your Personal Data may be transferred to Recipients located in several different countries. SEI implements appropriate safeguards to ensure the lawfulness and security of these Personal Data transfers, such as by relying on adequacy decisions from the European Commission, standard data protection clauses adopted by the European Commission, or other safeguards or conditions considered adequate to the transfer at hand.

• 7. Retention of Personal Data

  Personal Data processed for Recruitment activities will be kept by SEI for as long as is strictly necessary for the abovementioned purposes and, in any case, for 12 months upon receipt of the Application or its last update. SEI may contact Candidates before the expiration of this period, in order to request an extension of the retention period or its update. In case of no reply, SEI will delete the Personal Data collected.

  Personal Data processed for Compliance will be kept by SEI for the period required by the specific legal obligation or by the applicable law.

  Personal Data processed for preventing Misuse/Fraud will be kept by SEI for as long as is deemed strictly necessary to fulfil the purposes for which it was collected and therefore until the time SEI is required to keep them, in order to protect itself in court and to communicate this data to the competent Authorities.

• 8. Data subjects' rights

  As a data subject, you are entitled to exercise the following rights before SEI, at any time:

  • Access your Personal Data being processed by SEI (and/or a copy of that Personal Data), as well as information on the processing of your Personal Data;
  • Correct or update your Personal Data processed by SEI, where it may be inaccurate or incomplete;
  • Request erasure of your Personal Data being processed by SEI, where you feel that the processing is unnecessary or otherwise unlawful;
  • Request the restriction of the processing of your Personal Data, where you feel that the Personal Data processed is inaccurate, unnecessary or unlawfully processed, or where you have objected to the processing;
  • Exercise your right to portability: the right to obtain a copy of your Personal Data provided to SEI, in a structured, commonly used and machine-readable format, as well as the transmission of that Personal Data to another data controller;
  • Object to the processing of your Personal Data, based on relevant grounds related to your particular situation, which you believe must prevent SEI from processing your Personal Data.

  In any case, please note that, as a data subject, you are entitled to file a complaint with the competent supervisory authorities for the protection of Personal Data, if you believe that the processing of your Personal Data carried out is unlawful.
